Creative Entrepreneurship: Starting and Running an Arts-Based Business

Launching and successfully managing any business is a lot of work, but this workshop will provide artists, writers, designers, entertainers and any other creative entrepreneur with key information on a number of legal issues that are particularly relevant to arts-based businesses. Bring your business questions and real-world experiences to help guide the discussion.

Attorneys Caroline Kert and Shirin Chahal will discuss a number of legal essentials that you should be aware of, and will discuss real-world examples that provide lessons to be learned from others.  The workshop will review common mistakes often made, along with insights and best practices related to business entity formation (including nonprofits and public benefit corporations), contracts, fundraising, and the protection of intellectual property.

Meet the Presenters:

Caroline R. Kert is an attorney and a mediator who represents visual artists, musicians, playwrights and actors, and filmmakers as they grow the audience for their creative expression.  She also represents companies and employers with conflict resolution, whether that is obtained through the court systems, negotiated settlement, or mediation.

Ms. Kert has extensive experience with nonprofit, environmental, government, and arts organizations. When she is not in the office, Ms. Kert devotes her time to developing local and regional arts communities. She has served as a Director and President of Apogaea, Inc., a local 501(c)(3) arts organization associated with Burning Man, and she was a founding member of The Phoenix Asylum, a Boulder arts collective. 

She enjoys film, having worked on many student and professional sets and having attended the Colorado Film School for cinematography and directing. She also volunteers time as a community mediator through the City of Boulder Community Mediation Services, Boulder County Restorative Justice Program, and the Apogaea and Burning Man organizations.  She has also represented clients through the Lawyers for the Arts programs in Denver and Boston.

Ms. Kert also enjoys strategic games, including poker.

 

Shirin Chahal is an attorney whose practice is dedicated to serving mission-driven entrepreneurs, local small businesses, and the art and entertainment industries.

Ms. Chahal specializes in general business and transactional representation and advice, including entity formation and corporate governance, contract drafting and negotiation, securities compliance, and data privacy.  Ms. Chahal also routinely assists her clients in negotiating, obtaining, registering, transferring, licensing and commercializing intellectual property assets.  Finally, Ms. Chahal has a strong background in tax, and is able to counsel her clients on their tax compliance with extensive experience representing taxpayers before the Internal Revenue Service in tax audits and administrative appeals.

Shirin serves as a volunteer attorney for Colorado Attorneys for the Arts (CAFTA), and was recently awarded a Pro Bono Award by Boulder County Legal Services for her work with the legally underserved in her community.  Since 2013, Ms. Chahal has also volunteered for a number of flood and fire restoration projects with Boulder County Division of Parks and Open Space.

For fun, Shirin enjoys playing music, going to live concerts and shows, tending to her houseplant jungle, and hiking year-round with her greyhound.
